 Welcome to "AI TransFun" (the products and mobile applications (APP) of AI TransFun, hereinafter referred to as "AI TransFun")! This policy applies to the processing (including the collection, use, distribution, and use) any information or material by HuiEn. music through AI TransFun, Shenzhen HuiEn Technology Development Co. Ltd., and its subsidiaries and affiliates (collectively, "HuiEn," "we," or "us") through AI TransFun to process (including collect, use, share, transfer, disclose, etc.) Personal information (defined below).

We take your privacy very seriously, and to better protect your personal information, we recommend that you read the updated HuiEn. music Privacy Policy (the "Policy") carefully, especially the terms bolded in black, to understand what information we will collect about you and how we will use it and to ensure you fully understand and agree to it before you start using it. By agreeing to this policy, you consent to our processing of information about you per this policy. You should not use AI TransFun only if you have read and accepted all the terms of this policy.

This policy applies to personal information, including, but not limited to, personal information you voluntarily provide while using the AI TransFun service or as a result of the product or service. However, this policy does not apply to the use of your personal information by third parties, and we encourage you to familiarize yourself with the appropriate privacy policies of such third parties before providing them with information.

1. Relevant Definitions

Personal information: Personal information is all kinds of information recorded electronically or by other means relating to an identified or identifiable natural person, excluding anonymized information.

Sensitive Personal Information: Personal information that, once leaked or illegally used, can easily lead to the infringement of a natural person's human dignity or the endangerment of their personal or property safety. This policy includes personal biometric information (such as voiceprints, static or dynamic facial features, etc.), precise positioning information, and personal information of children under 14 (inclusive).

Anonymized Processing: Technical processing of personal information so that the subject of the user's data cannot be identified or recovered after processing.

De-identification Processing: De-identification Processing is the process of technically processing personal information so that the subject of the personal data cannot be identified or associated with the subject of the personal information without additional information.

 2. How we collect and use personal information

 

We handle personal information that you voluntarily provide while using our services, or that is required for our products and services bylaws and regulations, as well as the principles of propriety, legality, necessity, openness, transparency, and "minimization." We inform you of the relevant personal information's purpose and scope of use. Suppose we intend to use your personal information for purposes other than those stated in this policy or to use the collected data for other purposes based on specific objectives. In that case, we will inform you promptly and politely and obtain your consent again before use.

 

The types of personal information we collect and use about you are of two types:

Information Necessary for Basic Business Functions: This information is necessary for adequately functioning our products and services, and you must authorize us to collect it. If you refuse to provide it, you cannot use our products and services appropriately.

 

Information that may be required to be collected for extended business functionality: This information is not required for basic business functionality, and you have a choice whether to authorize us to collect it. If you refuse to provide it, it will result in the additional functionality being unavailable or unable to achieve the results we intend to achieve. However, it will not affect your regular use of the fundamental business functionality.

 In addition, you understand and agree that we want to provide you with products and services that are perfect, so we will continue to improve our products and services, including technology, which means that we may often introduce new business features that may require the collection of further personal information or change the purpose or manner of use of personal information. Suppose this policy does not describe a specific function, product, or service that involves the collection of your personal information. In that case, we will separately explain to you the purpose, content, usage, and scope of such information collection by updating this policy, email, mobile phone SMS, APP pop-ups, APP notification bar message push, etc., and provide you with the means to independently choose your consent and collect it with your express consent. In this process, if you have any questions about related matters, you can communicate with us through the contact information published in "How to Contact Us" in Article 10 of this Policy, and we will answer your questions as soon as possible.

We process the following types of personal information about you for the following purposes:

User registration and login

 When you create an account at AI TransFun, to become a member so that we can provide you with member services, you will need to provide (1) a mobile phone number and email address, (2) a username, and (3) a password.

When you use AI TransFun to maintain your basic information and improve your service experience, you must choose to fill in or improve the information required for the service, which may include your email address, mobile phone number, nickname, and so on. It does not affect your use of AI TransFun's essential business functions if you do not provide such information. To better provide you with after-sales service and firmware upgrade service, we need to collect your AI TransFun device serial number and AI TransFun device MAC address. We also need to manage your Android ID, as we need to use the virtual UUID as a unique identifier for your phone in buried and backend interface requests. Suppose you are using the Bluetooth headset model HuiEn EQ27. In that case, you will also need to fill in your biological sex, as the Daily Care Health feature included in HuiEn EQ27 needs to analyze your health status based on your biological sex. When you use AI TransFun to maintain your basic information and improve your service experience, it is necessary for you to choose to fill in and improve the information needed for the service, which may include your email address, mobile phone number, nickname, and so on. It does not affect your use of AI TransFun's essential business functions if you do not provide such information.

Audio playback function

While using AI TransFun for audio playback, we may need to collect browsing and playback history, favorites, etc., generated during your service.

 Provide information, display, and push for goods or services.

In the course of your use of our products and services, to provide you with a page display that better meets your needs, we may automatically collect your usage and store it as web log information and collect buried information such as the number of times and length of your page clicks, browsing, and other specific operations by planting points.

We may serve advertisements to you via open screen and discovery page banners, clearly labeled as "adverts," and allow users to reject or turn off pushes or advertisements by placing a skip or close button in the top right-hand corner of the open screen.

 Suppose you have any questions about the services for which we are recommending advertisements in accordance with the foregoing. You may use this policy's contact details in Article 10 ("How to Contact Us").

Message notification

 In our operation, we may send multiple types of notifications through your email, mobile phone text message, APP pop-up window, APP notification bar message push, etc., to inform users, identity verification, security verification, user experience research, etc.; in addition, we may also send you commercial information about product-related services, functions, or activities. If you do not wish to receive such information, you can communicate with us through the contact information published in Article 10, "How to Contact Us," of this policy.

Improving our services

To better understand your opinions and suggestions on AI TransFun's products and services, to improve the quality of our products and services, we may, with your consent, send or provide you questionnaires, conduct interviews, etc., by using third-party tools (Survey Monkey) via email, mobile phone text messages, APP pop-ups, and APP notification bar message pushes. In filling out questionnaires or interviews, depending on the type of questionnaire or interviews, you must provide different categories of your personal information. You may decline to complete the questionnaire or consultation if you do not wish to provide the above personal data.

In the course of your use of our services, to identify abnormal account status, understand product suitability, provide you with essential services such as browsing, ensure the regular operation of the services, and optimize the service experience, we may, directly or indirectly, collect, store, and correlate information about your use of the services and how you use the services, which communication includes log information and device information. To collect the above personal device information, we will apply for permission to access your device information.

 To conduct data analysis and research and improve the products and services we provide you, we may collect information when you interact with the AI TransFun platform. Such information may include your IP address, app operation history, mobile phone, and headset device information.

AI TransFunAPP permission call description

 To provide you with the services you choose to use or to ensure the quality and experience of the services, some of the functions offered by AI TransFun may require you to authorize the opening of operating system privileges. Suppose you do not agree to permit AI TransFun to obtain the relevant operating system permissions. In that case, it will not affect your use of the essential business functions we provided (except for the necessary operating system permissions on which the critical business functions are based). However, you may need help obtaining the user experience that Extended Business Services brings you.

Bluetooth permissions (Android, iOS versions): We need you to authorize us to access your Bluetooth permissions for pairing and connecting the AI TransFun product with other devices (e.g., your mobile phone).

 Camera access (Android and iOS versions): If you wish to use the AR Wearable feature provided by AI TransFun, we need you to authorize us to access your mobile phone's camera, and we will collect your facial information.

Album permissions (iOS version): we need you to authorize us to access your album permissions for storing pictures in the AR virtual wear feature.

Microphone permissions (Android, iOS versions): we need you to authorize us to access your phone's microphone permissions. We may collect information about your voice interactions with your voice. AI TransFun will capture your voice data when executing the relevant commands, send the data back to the third-party account service you selected, and forward the requested information. To better provide the Hear ID service, we also need you to authorize us to access your phone's microphone permissions to detect ambient noise when using HearID HuiEn. HearID ANC, wear fit detection, and other functions to improve the accuracy of the test.

 Read and Write External Storage Permission (Android Version): We need you to authorize us to access your Read and Write External Storage permission for storing images in the AR Virtual Wear feature.

Location permissions (Android version, IOS version): we need you to authorize us to access your location permissions for searching for nearby Bluetooth devices. Android 6 and higher versions must activate location services to search for Bluetooth devices.

Read call status permission (Android, iOS version): we need to get read call status permission for a music player (e.g., white noise playback) to listen to the incoming call status of the mobile phone. If music plays before the incoming call, it will switch to music pause and resume playing music after the call ends.

 Get app list permission (Android version): We need permission for the Firebase SDK to collect and push messages.

Instructions for Continuous Background Running

To provide the best user experience and functional performance, AI TransFun may need to run continuously in the background. Here are the details:

 Running and Stress Test Function: When you use the running and stress test function within your headset device, AI TransFun needs to run continuously in the background to monitor and give you real-time feedback on your physical performance. This is to ensure your health and safety when you are exercising or performing stress tests.

Adaptive Noise Control: When you enable the Adaptive Noise Control feature within your headset device, AI TransFun needs to run continuously in the background to monitor and control ambient noise in real-time while you sleep. This provides a quiet and comfortable sleep environment to ensure quality sleep.

 White Noise and Meditation Functions: When you use the White Noise and Meditation functions on the AI TransFun app discovery page, AI TransFun needs to run continuously in the background to ensure that the music playback is not interrupted and to provide a continuous relaxation and meditation environment.

Please note that by turning on any permissions, you authorize us to collect and use the relevant personal information to provide you with the corresponding services. Once you turn off any of the licenses, you have canceled the authorization. We will no longer continue to collect and use the relevant personal information based on the corresponding permissions. We cannot provide you with the related services based on such permissions. However, your decision to turn off your authorization will not affect the collection and use of information previously collected based on your approval. Unless you cancel your consent for personal data necessary for essential business functions, your cancellation will not affect the use of other parts.

Please be aware that, in accordance with laws and regulations, under certain circumstances, the collection and use of your personal information does not require your prior authorized consent. For specific exceptions, please refer to Section 4, "Exceptions to Authorized Consent" in Article 4 of this Policy.

1. How we use SDK technology

Our application will be embedded in the third-party partner's SDK or similar applications to ensure our mobile client's stable operation and function realization so that you can enjoy and use more services and functions.

 We will conduct strict security testing of application programming interfaces (APIs) and software tool development kits (SDKs) used by third-party partners to obtain information about them. We will agree on strict personal information protection measures with our authorized partners so that they handle personal data by this policy and any other relevant confidentiality and security measures. Please see the attachment "Description of Information Collected and Used by Third Party SDKs" at the end of this agreement.

 4. How we handle your personal information

Co-processing and commissioning

You are fully aware and agree that we may co-process and delegate the processing of your personal information in the provision of products or services to you in the following circumstances, beyond which we will separately seek your authorized consent through the notification described in Article 9:

Co-processing: We may co-process your information with third-party partners who help us operate, analyze, improve, customize, support, and market our products and services where we have obtained your separate consent or subject to the exceptions to authorized consent set out in Section 4 of Article IV.

 Commissioned Processing: Some specific modules and functions of some of HuiEn.external providers provide music's business functions. The third-party partners to whom we entrust the processing of personal data have access only to the information they need to fulfill their duties, and we monitor their delegated processing activities.

For example, to understand your feedback on our products, we may use a third-party Survey Monkey questionnaire platform in our research with you, and the content you fill out on the questionnaire will be stored on the servers of the appropriate forum.

As clearly stated in this policy statement, we will only delegate the processing and co-processing your information for lawful, legitimate, necessary, and specific purposes. We will conduct a reasonable review of our third-party partners' personal information security environment, sign strict personal information processing agreements with them to ensure that they only have access to the information they need to perform their duties and require them to take adequate measures to protect your data and strictly comply with relevant laws, regulations, and regulatory requirements.

Suppose our agreement with our third-party partners regarding the purpose and manner of processing changes materially affects the original intent and processing method. In that case, we will re-obtain your authorization consent. If you choose to cancel your authorization, we will stop the service to which the permission relates.

 Transfer

 We may transfer your personal information to other companies, organizations, or individuals where we have obtained your consent or where such transfer is consistent with the exceptions to authorized support set out in Section 4 of Article 4. In the event of a merger, acquisition, or insolvency, which may involve the transfer of personal information, we will require the new company or organization holding your personal information to continue to be bound by this policy. In the event of any changes to the collection and processing of personal data, as set out in this policy, the company or organization will re-solicit your authorized consent.

 Openly

We may disclose personal information when we obtain your consent or take industry-standard security measures following Section 4 of Article IV, "Exceptions to Authorized Consent." We will review the legitimacy, reasonableness, and legality of the disclosed personal information as soon as we receive a request for disclosure. We will take the measures described in Article 6 of this Policy to protect personal data during and after exposure.

 Exceptions to authorized consent

 Please be informed that, in accordance with laws and regulations, the processing of your personal information does not require your prior authorization under the following circumstances:

 Agreed:

Directly related to national security and defense security;

 For responding to public health emergencies,

(b) Directly related to the investigation, prosecution, trial, and execution of judgments in respect of offenses, or accordance with the requirements of laws and regulations, or the needs of an administrative organ or a competent organ such as the Public Prosecutor's Office or the Judiciary;

When it is necessary to protect the life, health, and property of a natural person in an emergency, such as when it is challenging to obtain your consent to protect your or another individual's life, property, or other significant legal rights and interests,

 Personal information is disclosed to the community by yourself or collected from legally declared channels (such as legal news reports, government information disclosure, and other media);

As necessary to enter into and perform the relevant agreement or other written document with you;

Necessary for the performance of legal duties or statutory obligations.

 5. How we store personal information

Storage location

Bylaws and regulations: we store your personal information collected and generated during our operations in the People's Republic of China. Currently, we do not transfer your data outside of China. However, under the following circumstances, we may provide your personal information to possible offshore entities after fulfilling our obligations under the law:

Storage period

We retain your personal information for the shortest period necessary for us to provide you with products and services that meet the purposes for which they are intended, e.g., we need to collect your mobile phone number when you use our registration and membership features, and we need to keep your mobile phone number after you have provided it and for the duration of your use of the part, to provide you with the feature correctly and to protect the security of your account and the system.

 We judge the duration of storage of personal information with reference to the following criteria, whichever is longer:

To fulfill the purpose of transactions related to you, maintain appropriate marketing and business records to respond to your possible inquiries or complaints;

To ensure the safety and quality of the products and services we provide to you,

Do you agree to a more extended retention period?

Whether there is any other special agreement on the duration of the reservation,

 The necessary period prescribed by law (e.g., the E-Commerce Law stipulates that information on goods and services and transaction information shall be kept for a period of not less than three years from the date of completion of the transaction)

After the storage period mentioned above, we will delete or anonymize your data, except in the cases described in Article 4, Section 4, "Exceptions to Authorized Consent."

 6. How we protect your personal information

 

We have established industry-standard security measures to protect the personal information you provide against unauthorized access, public disclosure, use, modification, damage, or loss. We will take all reasonably practicable steps to protect your personal information.

 After the unfortunate occurrence of a personal information security incident, we will, by the requirements of laws and regulations, promptly inform you of the following:

· the basic situation of the security incident and its possible impact

· the disposal measures we have taken or will take

· the suggestions you can independently take to prevent and reduce the risk

· the remedial measures for you

We will promptly inform you of the situation related to the incident by email, mobile phone text message, APP pop-up window, APP notification bar message push, and other means. When it is challenging to individually inform the subject of personal information, we will find reasonable and effective ways to publish announcements. At the same time, we will also take the initiative to report the disposition of personal information security incidents to the requirements of the regulatory authorities.

 7. How we manage your personal information

Access and Updates

 We encourage you to update and correct your information to make it more accurate and valid. To the extent possible, we will ensure you can access, update, and correct your information or other information provided when using AI TransFun by adopting appropriate operational settings, guidelines, or a contact channel for submitting requests.

If you would like to access, update, and correct some of your information, you can log into your account and visit your account settings page to review and change your account profile information. You may also contact us via the contact information posted in Article 10, "How to Contact Us," of this policy. Except as otherwise required by law or regulation, when you correct your personal information, we may not immediately correct or delete the corresponding information from our backup system. However, we will fix or delete the data when the backup is updated.

Change the scope of your authorized consent or withdraw your authorization.

 You may change the scope of your authorization for us to continue to collect personal information or withdraw your permission by deleting the data, turning off the device's functionality, etc. You may remove all authorization for us to continue to collect your personal information by canceling your account. Please understand that each business function requires some primary personal data to be completed. When you withdraw your consent or authorization, we cannot continue to provide you with the services for which you have withdrawn your consent or permission. We will no longer process your personal information. However, your decision to withdraw your consent or authorization will not affect the collection, processing, or use of data previously collected based on your permission.

Cancellation and Deletion

We provide you with the function to unregister and delete your registered account. In compliance with the conditions stipulated in the service agreement and relevant laws and regulations of the country, you can log in to your account and access your account settings page to delete your account. The path to unregister your account while logged in is My - Personal Information - Delete account. You can also submit a request to delete your account by emailing huien01@huiendz.com.

 In the following cases, you may request us to delete your personal information:

 If our handling of personal information violates laws and regulations,

If we collect and use your personal information without your consent,

If we process personal data in breach of our agreement with you,

 If you no longer use our products or services, or if you cancel your account,

If we no longer provide products or services to you,

Suppose we respond to your request for deletion. In that case, we will also notify, as far as possible, the entities that have obtained your personal information from us and ask them to delete it promptly unless otherwise required by law or regulation or if you have independently authorized these entities to do so. Once you or we have assisted you in deleting the information in question, we may not be able to immediately delete the information from our backup systems because of applicable laws and regulations and security techniques, and we will store your data securely. We will only process it further once the backups can be erased or made anonymous.

 Automated decision-making in constraint information systems

In certain business functions, we may make decisions based solely on non-human, mechanical decision-making mechanisms, including information systems, algorithms, etc. If these decisions significantly affect your legitimate interests, you have the right to an explanation, and we will provide appropriate remedies.

Responding to your request above

We take each of your requests very seriously. At the same time, you understand and agree that we may not be able to respond to your request promptly under the circumstances described in Article IV, Section 4, "Exceptions to Authorized Consent.

 8. Protection of minors

 

AI TransFun's products and services are not intended to be used exclusively by minors. Minors should obtain the consent of their guardians before using our products and services. Suppose you are a minor before using our products or services. In that case, you should read this policy under the supervision and guidance of your guardian, use our products or services, and submit personal information with your guardian's express consent and direction. We protect the personal information of minors by relevant national laws and regulations. We will only handle the personal information of children when permitted by laws and regulations and with the explicit consent of the guardian.

 Suppose you are the guardian of a minor. In that case, you may communicate with us to resolve any questions you may have about the personal information of a child under your guardianship by using the contact information listed in Article 10, "How to Contact Us" of this Policy. If we discover that we have collected personal information from a minor without obtaining verifiable consent from the guardian, we will delete the personal data as soon as possible.

 9. Revision and updating of this policy

To provide you with better services, we may promptly modify the terms and conditions of this policy by updating AI TransFun's products and services as well as the relevant requirements of laws and regulations, and we will post any modifications to this policy on this page, which form part of this policy. We will also provide more prominent notifications for material changes (including email, mobile phone text messages, APP pop-up window, APP notification bar message push, or other means). Material changes within the meaning of this policy include, but are not limited to:

Significant changes to our service model. For example, the purposes for which personal information is processed, the types of personal data processed, and how personal information is used

 are significant changes in our ownership structure. For example, changes in ownership due to business restructuring, bankruptcy, and mergers and acquisitions;

There is a substantial change in the primary recipients of personal information that is shared, transferred, or publicly disclosed.

Significant changes in your rights to participate in the processing of personal information and how you can exercise them

 There have been significant changes to the department responsible for dealing with the security of personal information, our contact details, and complaint channels;

When a personal information security impact assessment report indicates a high risk,

 Other important events that may seriously affect your rights and interests occur.

If you do not agree with these changes, you may choose to stop using the AI TransFun service. By continuing to use the AI TransFun service, you acknowledge that you have fully read, understood, and agreed to be bound by this policy as amended. Your satisfaction will be our top priority in any modifications we make. We encourage you to review this policy each time you use the AI TransFun service.

We may make service-related announcements when necessary (e.g., suspending, changing, or terminating a service due to system maintenance). Suppose you wish to refrain from receiving messages from us. In that case, you may ask us to stop, for example, by requesting us to stop sending promotional text messages by the SMS Unsubscribe Guidelines or by setting up your mobile device to no longer receive notifications from us, except where we are required by law or have agreed to send messages in accordance with the Service Agreement.
